ORDER
On June 11, 2008, this court held a telephonic hearing on defendants' motion to stay proceedings and for an extension of time to file its answer or other response. See Dkts. 11-12. Both sides were represented by counsel.
After discussing the motions and the current state of proceedings in the Southern District of Indiana, I denied both motions as currently framed. Because there currently is no sister case pending in Indiana, there is no reason for this court to stay proceedings in the instant case. Defendant remains free to file a motion to dismiss or to transfer. As discussed with counsel, defendant may have until July 3, 2008 within which to file and serve any response, with plaintiff's response in opposition (if any) to follow, and a reply thereafter from defendant if necessary. I have set forth the entire schedule for this case in a separate preliminary pretrial conference order.
