Zerby v. State

District Court of Appeal of Florida, Second District
Mar 13, 1996
680 So. 2d 463 (Fla. Dist. Ct. App. 1996)

Opinion

No. 94-03087.

March 13, 1996.

Appeal from the Circuit Court for Hillsborough County; Barbara Fleischer, Judge.

James Marion Moorman, Public Defender, and Douglas Chanco, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Stephen D. Ake, Assistant Attorney General, Tampa, for Appellee.

Victor Charles Zerby appeals an order of restitution and certain costs imposed, specifically arguing that the trial court erred in setting the amount of restitution and improperly imposed cost for the Court Improvement Fund. We affirm the amount of restitution. We strike the $15 cost for the Court Improvement Fund. See Reyes v. State, 655 So.2d 111 (Fla. 2d DCA 1995) (en banc).

PARKER, A.C.J., and ALTENBERND and WHATLEY, JJ., concur.
