The proper inquiry is whether "an investigation would have disclosed a suspected factual basis for a cause of action." Zenga v. Greenberg Glusker Fields Claman & Machtinger , No. B248318, 2014 WL 4746251, at *4 (Cal. Ct. App. Sept. 24, 2014). The record clearly demonstrates that in the instant case, an investigation would have revealed a suspected factual basis for Plaintiffs' claims.
