An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about June 12, 2017, and said appeal having been perfected, And defendant-respondent Michael J. Faust, M.D. having moved for an order allowing respondents to supplement the record on appeal to add materials from a legal malpractice action brought by plaintiff-appellant against a former attorney regarding the issues involved in this case (M-66), And plaintiff-appellant Ricky Zegelstein, M.D. having cross-moved for the imposition of sanctions against defendant-respondent, for a change of venue, and other relief (M-491), Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon, It is ordered that the motion and cross motion are denied.
