JOHN BRETT ZEAGLER, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan Chief Judge.

On August 28, 2023, respondent filed a Motion to Dismiss for Lack of Jurisdiction (Docket Index No. 6). On August 28, 2023, respondent also filed a second Motion to Dismiss for Lack of Jurisdiction (Docket Index No. 7), which is duplicative of the first motion to dismiss filed.

Upon due consideration of the foregoing, it is

ORDERED that respondent's Motion to Dismiss for Lack of Jurisdiction, filed August 28, 2023, at Docket Index No. 7, is deemed stricken from the Court's record in this case. It is further

ORDERED that, on or before September 20, 2023, petitioner shall file an Objection, if any, to respondent's Motion to Dismiss for Lack of Jurisdiction, filed August 28, 2023, at Docket Index No. 6. Failure to file an objection may result in the granting of respondent's motion and dismissal of this case for lack of jurisdiction.
