In an action to recover damages for breach of a stock option plan, the plaintiffs appeal: (1) from an order of the Supreme Court, Kings County, dated March 28, 1960, granting defendant's motion to dismiss the complaint under rule 106 of the Rules of Civil Practice, for failure to state a cause of action; and (2) from a judgment of said court, entered March 30, 1960, upon said order, dismissing the complaint. Order and judgment affirmed, without costs. No opinion. Nolan, P.J., Kleinfeld, Christ, Pette and Brennan, JJ., concur.
