An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about August 14, 2019, and said appeal having been dismissed by an order of this Court, entered on February 9, 2021 (M-2021-00010),

And plaintiff-respondent having moved, pro se, for an extension of time to file a respondent's briefs (M-2021-00454),

And defendant-appellant having moved to vacate the dismissal of the appeal, or in the alternative, for the record to reflect an exception due to an inconsistency with this Court's prior order (M-2020-02395), entered August 27, 2020 (M-2021-00512),

Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon,

It is ordered that plaintiff-respondent's motion is deemed withdrawn in accordance with the pro se letter dated February 11, 2021 (M-2021-00454), and

It is further ordered that defendant-appellant's motion is denied in its entirety (M-2021-00512). ENTERED: March 30, 2021
