An appeal having been taken from an order of the Supreme Court, New York County, entered on or about August 14, 2019, and said appeal having been perfected, And defendant-respondent having moved to dismiss the aforesaid appeal, or in the alternative to strike the record on appeal and plaintiff's appellants brief, or alternatively adjourning the appeal to the next available Term, and other relief, And the appeal having been adjourned to the October Term by order of a Justice of this Court dated April 6, 2000, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the branch of the motion seeking to dismiss the appeal is granted. The motion is otherwise denied as academic.
