IT IS ORDERED that the Motion to Dismiss filed by defendants, Deputy Karry Falcon, individually and in his official capacity, and Sheriff Michael W. Neustrom, in his official capacity, [Rec. Doc. 59] be GRANTED and this action be DISMISSED WITH PREJUDICE.
