Elijah Young, Jr., petitioned for a belated appeal and we appointed a commissioner to resolve factual allegations that Young's request for an appeal was frustrated. Based upon the Commissioner's report, we grant the petition for belated appeal and this opinion shall be treated as a notice of appeal.

PETITION GRANTED.
