In lieu of granting leave to appeal, the case is remanded to the Wayne Circuit Court. MCR 7.302(F)(1). On remand, the trial judge may reconsider the initial finding that the incident report was collected by a committee assigned a review function within the meaning of the statute as well as consider whether the confidentiality of the incident report has been waived because the committee receiving the report undertook risk management functions as well as peer review functions.
