MARTIN M YOUNCE v. PATRICK TORTORA

LC No. 21-001115-CH

ORDER

Mark T. Boonstra, Judge, acting under MCR 7.211(E)(2), orders:

Appellants' motion "to extend time to file appellants' brief to order and receive additional transcripts necessary to provide accurate information and documentation in the appeal brief" is GRANTED TO THE EXTENT that appellant shall have 28 days, calculated from the date of the filing of newly-ordered transcripts with the trial court, to file appellants' brief on appeal. Within 14 days of the date of the Clerk's certification of this order, appellants' counsel must ensure the filing of a stenographer's certificate in this Court, which evidences the ordering of all previously unordered hearing transcripts for this case. Further, counsel is advised of the requirement to order "the full transcript of testimony and other proceedings," MCR 7.210(B)(1)(a), in order to appropriately pursue an appeal; counsel may not order only the "transcript(s) the appellant believes are relevant to the appeal," IOP 7.210(B)(1)-1. At the outset of this appeal, counsel represented on the jurisdictional statement that he ordered the "complete transcript," but this was not correct because full transcripts of all testimony and other proceedings had not been ordered.
