Action to recover damages for personal injuries sustained by plaintiff when a motor driven scooter upon which he was riding was in collision with defendant Cohen's automobile. Judgment reversed on the facts and a new trial granted, with costs to abide the event, on the ground that the verdict is against the weight of the evidence, and in the interests of justice. Lazansky, P.J., Hagarty, Carswell, Adel and Close, JJ., concur.
