ORDER


Before the Court is petitioner, Donald York's, motion for extension of time to file a notice of appeal. The original deadline for filing a notice of appeal in the above captioned case was November 16, 2003. Petitioner alleges that he mistakenly mailed his notice of appeal to the court of appeals rather than to the district court. The notice of appeal was received by the Tenth Circuit Court of Appeals on November 10, 2003 and returned to petitioner on Friday, November 14, 2003 leaving petitioner without sufficient time to file a timely notice of appeal with the district court.

The Court finds that there is good cause to extend petitioner's time to file a notice of appeal for 30 days past petitioner's original deadline. Petitioner's new deadline for filing a notice of appeal in the above captioned case is December 16, 2003. IT IS SO ORDERED.
