Appellant filed a "Motion to Dismiss the Appeal and Not Issue a Mandate" on August 3, 2017, after this Court's May 23, 2017 opinion and judgment had issued to dismiss this appeal, and one day before this Court's mandate was set to issue on August 4, 2017. See TEX. R. APP. P. 18.1(a). Accordingly, appellant's motion, construed as a motion to dismiss the appeal or to stay issuance of the mandate, is dismissed as moot because this appeal had already been dismissed when the motion was filed, and our mandate issued on August 4, 2017. See id. 18.2 (stating that party may move to stay issuance of mandate pending U.S. Supreme Court's disposition of petition for certiorari).
