ORDER
On July 13, 2016, appellant Shabahram Yazdani-Beioky filed an unopposed motion to reinstate the instant appeal and an opposed motion to set a briefing schedule. On July 18, 2016, appellee/conditional cross-appellant Abdee Sharifan also filed a motion to set a briefing schedule.
Appellant seeks a briefing schedule pursuant to the deadlines outlined in Rule 38.6 of the Texas Rules of Appellate Procedure, noting that the Rule does not distinguish deadlines in the event of a cross-appeal. Appellee, who has stated that his cross-appeal is conditional, seeks a briefing schedule which would allow him to file his appellee brief/cross-appellant opening brief responsively. The motions are granted, in part.
To the extent appellant's motion seeks reinstatement of this appeal, the motion is granted, and the appeal is reinstated. However, in the interest of judicial economy, we find appellee's proposed briefing schedule more favorable. Appellee's motion to set briefing schedule is granted.
Accordingly, we order the following:
Appellant Yazdani-Beioky's opening brief is due September 23, 2016.
Appellee Sharifan's response brief/cross-appellant opening brief is due no later than 30 days after the date appellant's brief is filed.
Yazdani-Beioky's reply/cross-appellee brief is due no later than 30 days after the date the appellee/cross-appellant's brief is filed.
Sharifan's reply brief is due 20 days after the date the cross-appellee's brief is filed.
The aggregate number of words for all briefs filed by any party may not exceed 37,500 words if computer-generated, and 125 pages if not. The calculation of length will be made as specified by Texas Rule of Appellate Procedure 9.4(i).
