MEMORANDUM OPINION


The clerk's record is overdue in this appeal. See Tex. R. App. P. 35.1. On January 26, 2009, the Clerk of the Court directed appellant to provide the Court, within ten days, with written verification showing either that appellant has paid or arranged to pay for the clerk's record or that appellant is entitled to proceed without payment of costs. See Tex. R. App. P. 37.3(b). We warned appellant that failure to comply could result in dismissal of the appeal. Appellant has not filed the requested documentation regarding the clerk's record. Accordingly, we DISMISS the appeal for want of prosecution. See Tex. R. App. P. 42.3 (b), (c).
