Court of Appeals of Texas, Fifth District, Dallas
Mar 17, 2009
No. 05-08-00993-CV (Tex. App. Mar. 17, 2009)

Opinion

No. 05-08-00993-CV

Opinion Filed March 17, 2009.

On Appealed from the County Court at Law No. 1, Dallas County, Texas, Trial Court Cause No. 05-15833-A.

Before Justices RICHTER, LANG, and MURPHY.

MEMORANDUM OPINION

This appeal has been pending since July 22, 2008 and the clerk's record was filed on September 19, 2008. After being granted three extensions and denied a fourth, appellant tendered a brief on February 2, 2009 that did not comply with the Texas Rules of Appellate Procedure. We directed appellant to file an amended brief that complied with the rules and granted him an extension of time beyond the ten days specified in the letter identifying the deficiencies. In our February 18, 2009 order granting appellant the extension of time to file his amended brief, we warned appellant that no further extensions would be granted and that if he did not file an amended brief, we would dismiss the appeal without further notice. Rather than tendering his amended brief, appellant filed a subsequent motion to extend time to file the amended brief. By order of March 13, 2009, we denied the extension motion and struck the deficient brief tendered on February 2, 2009. There is now no appellant's brief before the Court.

Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a), 42.3.
