Appeal and Error — Reversal in Default of Answer Brief.

Where the defendant in error fails to file brief, this court may exercise its discretion under rule 7 of the rules of this court and reverse the cause without an examination of the record.

Error from District Court, Okmulgee County; James M. Hays, Judge.

Action between Steve Xezonatos et al. and the Culinary Local No. 172 of the Hotel and Restaurant Employees International, etc., League of America et al. From the judgment, the former appeal. Reversed and remanded.

G. L. Bynum and George T. Bonstein, for defendants in error.


Upon authority of Ellis v. Outler, 25 Okla. 468, 108 P. 957, this cause is reversed and remanded for failure of the defendants in error to file brief as required by rule seven of this court.
