Wynn v. State

District Court of Appeal of Florida, Fourth District
Jun 10, 1987
508 So. 2d 44 (Fla. Dist. Ct. App. 1987)

Opinion

No. 87-1192.

June 10, 1987.

Appeal of order denying Rule 3.850 motion from the Circuit Court for Broward County; Leroy H. Moe, Judge.

Raymond Wynn, pro se.

No appearance required for appellee.

Reversed. We believe the trial court erroneously dismissed the petition for lack of jurisdiction. Although the appellant has another appeal pending in this court, it involves a separate case and does not deprive the trial court of jurisdiction in this case.

HERSEY, C.J., and ANSTEAD and STONE, JJ., concur.
