ORDER
Before the Court is appellants' December 12, 2017 motion to supplement the clerk's record on appeal. Appellants ask we order the clerk's record be supplemented with a copy, which they attach, of (1) the reporter's record of the July 30, 2017 trial; and (2) "TBC Excerpts of James Francesconi's Testimony and Various Motions Hearing."
It appears from the motion that appellants filed a supplemental designation of the clerk's record on November 7, 2017 requesting these documents be included in a supplemental record. The motion does not reflect, however, if appellants have received an invoice for the cost of preparation of the record and have paid the fee. See TEX. R. APP. P. 35.3(a)(2). Accordingly, we GRANT the motion to the extent we ORDER Collin County District Clerk Lynne Finley to file, no later than January 2, 2018 either (1) the supplemental clerk's record containing the items designated by appellants or (2) written verification appellants have been informed of the cost of the record but have not paid the fee.
We DIRECT the Clerk of the Court to send a copy of this order to Ms. Finley and the parties.
