ORDER NUNC PRO TUNC


Pursuant to the oral request of the parties, the first sentence of the first full paragraph on page two of the Court's October 17, 2003 Order (doc. 425) is revised to read:

Given this Court's Memorandum and Order granting the State of Kansas' previous Motion to Intervene, and based on the statements made by the State of Kansas' regarding its intent to expressly waive its sovereign immunity with respect to the equitable and declaratory claims to the Claimed Lands as set forth above, Plaintiff is deemed to have waived (see doc. 50) its sovereign immunity with respect to any counterclaim by the State of Kansas for quiet title of its interest in said Lands.

IT IS SO ORDERED.
