578 So. 2d 894 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-1298.

May 7, 1991.

An Appeal from the Circuit Court for Dade County; Mary Ann MacKenzie, Judge.

Bennett Brumer, Public Defender and Rosa C. Figarola, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen. and Michael J. Neimand, Asst. Atty. Gen., for appellee.

Before SCHWARTZ, C.J., and JORGENSON and GERSTEN, JJ.

On Confession of Error

Upon consideration of the brief of appellant, the record and the state's confession of error, the Delinquency Disposition Order under review shall be amended to reflect an adjudication of resisting an officer with violence as alleged in count II of the Petition for Delinquency instead of the incorrect statement that the adjudication was based on an aggravated assault. The order is otherwise affirmed.
