BY ORDER OF THE COURT.

The notice of appeal for case number 2D14–362 seeks to initiate judicial review of a decision rendered on December 18, 2013. It has been discovered that this court in case number 2D13–1743 in which appellant was a party issued an affirmance on December 18, 2013.

After consideration of appellant's response, this court's order to show cause issued in 2D14–362 and dated May 23, 2014, is discharged. It now appears that the notice of appeal filed pursuant to the mail box rule on December 29, 2013, was a timely attempt to invoke the discretionary jurisdiction of the Florida Supreme Court to review this court's decision in 2D13–1743.

Accordingly, the notice of appeal docketed in 2D14–362 is transferred to 2D13–1743 and is treated as a notice to invoke the discretionary jurisdiction of the Florida Supreme Court.

In addition, 2D14–362 is dismissed as improvidently initiated.
