Wright v. State

Supreme Court of Alabama
Jun 7, 1996
678 So. 2d 1220 (Ala. 1996)

Opinion

1950986.

June 7, 1996.

Petition for Writ of Certiorari to the Court of Criminal Appeals (Macon Circuit Court, CC-94-0089; Court of Criminal Appeals, CR-94-0835); Lewis H. Hamner, Jr., Judge.

Jeff Sessions, Atty. Gen., and John J. Park, Jr., Asst. Atty. Gen., for Petitioner.

No brief filed for respondent.

WRIT DENIED.

HOOPER, C.J., and ALMON and BUTTS, JJ., concur.

HOUSTON, J., concurs in the result.

I would not vote to reverse the judgment of the trial court except for the fact that the district attorney's secretary remained silent. She was seated next to the district attorney during voir dire examination. It is obvious that she knew her former mother-in-law, the grandmother of her child. She should have revealed that fact to the court, the prosecution, and the defense.
