LAVELL JOHNNY WRIGHT, Appellant, v. ISIDRO BACA, WARDEN, Respondent.

ORDER OF AFFIRMANCE

Lavell Johnny Wright appeals from an order of the district court denying a postconviction petition for a writ of habeas corpus filed on August 16, 2019. Eleventh Judicial District Court, Pershing County; Jim C. Shirley, Judge.

In his petition, Wright claimed the Nevada Department of Corrections failed to apply the 104 days of presentence credits he was awarded in his judgment of conviction to his minimum term. The district court found that Wright was sentenced on April 15, 2019, and he was given 104 days of presentence credit. The district court also found that Wright's retroactive date for beginning to serve his sentence was January 1, 2019, which was exactly 104 days prior to Wright's sentencing date. Therefore, the district court concluded Wright properly received the 104 days of presentence credit. The record supports the decision of the district court, and we conclude the district court did not err by denying Wright's petition. Accordingly, we

ORDER the judgment of the district court AFFIRMED.
