ORDER STAYING PROCEEDINGS FOR SIXTY (60) DAYS
This matter having been opened to the Court by Carella, Byrne, Bain, Gilfillan, Cecchi, Stewart Olstein (by John M. Agnello, Esq.), attorneys for Defendants/Third Party Plaintiffs, and by Lowenstein, Sandler, PC (by Lawrence M. Rolnick, Esq.), attorneys for Plaintiffs and Third Party Defendants, and counsel for the parties having indicated to the Court that there is a good faith belief that this matter will be settled, and for good cause shown;
It is on this 23 day of July, 2007,
ORDERED AS FOLLOWS:
1. All proceedings in this matter be and are hereby stayed for a period of sixty (60) days from the date hereof; and
2. Counsel for the parties are directed to advise the Court within forty-five (45) days of this Order as to the status of the settlement; and
3. In the event that this matter is not settled within sixty (60) days of the date hereof, the Court will schedule a Status/Settlement Conference.
4. Plaintiffs' Appeal of a Magistrate Decision [CM/ECF Docket Entry No. 79], Plaintiffs' Motion to Dismiss [Entry No. 93] and Defendant's Motion to Seal [Entry No. 97] are hereby dismissed without prejudice. Either party may reinstate any of the aforesaid motions upon written request to the court setting forth that the matter did not settle and requesting reinstaterment of any of the a fore Said motions.
