Worth v. R.J. Macher Realty Corporation

Appellate Division of the Supreme Court of New York, Second Department
Nov 1, 1931
234 App. Div. 801 (N.Y. App. Div. 1931)

Opinion

November, 1931.

Judgment dismissing complaint as to the individual defendants reversed upon the law and a new trial granted, costs to appellant to abide the event. The plaintiff established a prima facie case against said defendants and the court, therefore, erred in dismissing the complaint as to them. Lazansky, P.J., Carswell, Scudder, Tompkins and Davis, JJ., concur.
