DECISION AND ORDER ON MOTION

Application for extension of time to perfect appeal from order entered November 13, 2012, for permission to proceed as a poor person, for assignment of counsel and for further relief.

Upon the papers filed in support of the application, and no papers having been filed in opposition thereto, it is

ORDERED that the application for an extension of time to perfect the appeal is denied, without costs, and the appeal is dismissed (see Matter of Sital v Fischer, 76 AD3d 723, 724 n [2010]), and it is further

ORDERED that the application for permission to proceed as a poor person, for assignment of counsel and for further relief is denied, without costs, as academic.
