Motion to consolidate and for extension of time to perfect appeal and cross appeals taken by defendant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion for an extension of time to perfect appeal and the cross appeal taken by defendant is granted, without costs, and the time to perfect the appeal and the cross appeal is extended to October 31, 2011, and it is further
ORDERED that the motion to consolidate is granted, without costs, to the extent that the appeal and the cross appeal shall be heard together and may be perfected upon a joint record on appeal and brief.
