Ameal Woods and Jordan Davis v. The State of Texas

281st District Court of Harris County Trial court case number: 2019-39625

ORDER

AMPARO MONIQUE GUERRA, JUDGE

The appellate record in this appeal was originally due on December 5, 2023. On December 4, 2023, the court reporter filed a first request for extension of the deadline to file the reporter's record. In the first request for extension, the court reporter requested that the deadline to file the reporter's record be extended to January 4, 2024. On December 4, 2023,the Court granted the court reporter's first motion to extend the deadline to file the reporter's record. See Tex. R. App. P. 35.3(c) (extensions for filing record may not exceed thirty days).

On January 4, 2024, the court reporter filed a second request for extension to file the reporter's record. In the second request for extension, the court reporter requested that the deadline to file the reporter's record be extended to February 3, 2024. On January 4, 2024,the Court granted the court reporter's second motion to the extend the deadline to file the reporter's record, but notified the court reporter that no further extensions would be granted.

However, on February 5, 2024, the court reporter filed a third request for an extension of the deadline to file the reporter's record. The third request for extension notes that there are ten days of testimony, amounting to approximately 2,000 pages. The court reporter states that she has been unable to complete the record, and requests that the deadline be extended to March 6, 2024.

The court reporter's third request for an extension of time to file the reporter's record is granted. See Tex. R. App. P. 35.3(c) (requiring courts to ensure that appellate record is timely filed). The court reporter is directed to file the reporter's record no later than March 6, 2024. No further extensions will be considered, and the failure to file the reporter's record by the extended deadline will result in the abatement of this appeal for the trial court to conduct a hearing to determine the reason for failure to file the reporter's record.

It is so ORDERED.
