An inference of discrimination can be found when there is disparate treatment, i.e., when persons with the same or similar characteristics as the challenged juror are not struck. Branch, 526 So.2d 624. Marital status may be a sufficient race-neutral reason, if there is no evidence of disparate treatment. Woods v. State, 675 So.2d 50 (Ala.Crim.App. 1995). In the present case, there was evidence of disparate treatment.
