The order appealed from dismissing Count II of appellant's amended complaint is not an appealable order since the action is not one formerly cognizable in equity and Count II is not a cause of action separate from the cause of action stated in Count I.

Accordingly, the appeal is dismissed for lack of jurisdiction.

DOWNEY, ANSTEAD and LETTS, JJ., concur.
