ORDER TO SHOW CAUSE

This case is currently calendared for trial at the Session of the Court commencing on March 20, 2023, in Dallas, Texas. On February 27, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. The motion states that respondent is unclear as to whether petitioner objects to the granting of this motion. To this end, it would be helpful for the Court to hear from petitioner regarding respondent's motion and the status of this case. The motion also states that respondent will secure Form 3050, Certificate of Lack of Record and the Substitute for Return (SFR) package to show that petitioner did have estimated tax payments due for the 2017 taxable year (which is the year at issue) that he did not pay. Upon due consideration, it is hereby
ORDERED that petitioner shall contact the chambers of the undersigned Judge at (202) 521-0822 as soon as possible for the purpose of scheduling a conference call to discuss respondent's motion to dismiss for failure to properly prosecute and the status of this case. It is further
ORDERED that respondent shall, on or before March 14, 2023, file a status report or a supplement to his motion to dismiss for failure to properly prosecute appending as Exhibits the Form 3050 and the SFR package to show that petitioner did have estimated tax payments due for 2017 that he did not pay. It is further
ORDERED that petitioner shall show cause in writing, on or before March 14, 2023, why this case should not be dismissed for failure to properly prosecute.
