On November 21, 2023, appellant Larry Demetricus Woodruffe filed a motion for en banc reconsideration of this Court's August 1, 2023 opinion and judgment.

A motion for en banc reconsideration must be filed within the time prescribed to file a motion for rehearing. Tex.R.App.P. 49.5. A motion for rehearing may be filed within 15 days of the court's judgment. Tex.R.App.P. 49.1. "A motion for en banc reconsideration must be filed by the deadline for filing an initial motion for rehearing...." Tex.R.App.P. 49 cmt. to 2021 change.

This court issued its opinion and judgment on August 1, 2023. Woodruffe did not file his motion for en banc consideration within 15 days of the court's judgment. Therefore, Woodruffe's motion for en banc reconsideration is untimely. Tex.R.App.P. 49 cmt.

The motion for en banc reconsideration is denied.

IT IS SO ORDERED.
