On December 26, 2002, we remanded this case to the Court of Appeals, while retaining jurisdiction. Woodbury v Bruckner, 467 Mich. 921 (2002). In conformance with our order, the Court of Appeals later remanded this case to the Monroe Circuit Court for further proceedings. It now appearing that this case may be moving toward a trial on the merits, we AMEND our December 26, 2002 order to delete the retention of jurisdiction.

If the Court of Appeals chooses, it may likewise amend its February 3, 2003 order to delete the retention of jurisdiction.
