PRESENT:

Petitioners-appellants having moved for permission to proceed as poor persons and for assignment of counsel on the appeals taken herein from orders of the Family Court, Wayne County, entered in the Office of the Clerk of said Court on May 1, 2018,

Now, upon reading and filing the affidavit of John Wood and Lori Wood, sworn to September 18, 2018, the notice of motion with proof of service thereof, the statement of Erin M. Hammond, Esq., dated September 26, 2018, and the statement of Gary Lee Bennett, Esq., dated October 9, 2018, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks the assignment of counsel is denied on the ground that such relief is not authorized (see Family Court Act §§ 262, 1120 [a]), and

It is further ORDERED that the motion insofar as it seeks poor person relief is denied on the ground that the facts set forth by appellants fail to demonstrate merit to the appeal (see CPLR 1101 [a]).
