Opinion

No. 87-8.

March 25, 1988.

An appeal from Circuit Court for Leon County; Charles D. McClure, Judge.

Michael E. Allen, Public Defender, and Kenneth L. Hosford, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., and Gregory G. Costas, Asst. Atty. Gen., Tallahassee, for appellee.

The state having conceded that the trial court erred in failing to give 109 days jail-time credit in case number 85-4226, Daniels v. State, 491 So.2d 543 (Fla. 1986), the sentence in that case is reversed and remanded with directions to allow such credit.

BOOTH, WIGGINTON and ZEHMER, JJ., concur.
