THE COURT:

It is ordered that the opinion filed herein on August 29, 2003, be modified as follows:

1. On page 25, in the Disposition, following the sentence "The judgment is affirmed" add the following sentence:

"Respondents are awarded their costs on appeal." This modification changes the judgment.
