Order

On order of the Court, the application for leave to appeal the August 12, 2021 judgment of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we VACATE Part III of the Court of Appeals judgment, and we REMAND this case to the Court of Appeals for reconsideration in light of Rott v. Rott , ––– Mich. ––––, ––– N.W.2d ––––, 2021 WL 3234466 (decided July 30, 2021, Docket No. 161051). The application for leave to appeal as cross-appellant is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court.

We do not retain jurisdiction.
