JACK WILLIAM WOLF, Defendant Below-Appellant, v. STATE OF DELAWARE, Plaintiff Below-Appellee. No. 568, 2002 In the Supreme Court of the State of Delaware. Submitted: October 25, 2002 Decided: November 25, 2002

Before HOLLAND, BERGER, and STEELE, Justices.

Carolyn Berger Justice

ORDER

This 25th day of November 2002, after careful consideration of appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment below should be affirmed on the basis of the Superior Court's well-reasoned decision dated September 12, 2002. The Superior Court did not err in concluding that Wolf's motion for postconviction relief was time-barred and formerly adjudicated, and Wolf had failed to overcome these procedural hurdles.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
