In an action to recover amounts alleged to have been paid in excess of emergency rent for commercial space, and to recover damages, order directing examination of defendant before trial, insofar as appealed from, affirmed, without costs, the examination to proceed on five days' notice. No opinion. Nolan, P.J., Carswell, Johnston, Adel and MacCrate, JJ., concur.
