On order of the Court, the application for leave to appeal from the December 18, 2001 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals and REMAND the case to the Oakland Circuit Court for reinstatement of that court's decision dismissing the complaint. The trial court did not abuse its discretion in dismissing the case for lack of progress. See Alken-Ziegler, Inc vWaterbury Headers Corp, 461 Mich. 219 (1999).

Kelly, J., would deny leave to appeal.
