Present — Carswell, Acting P.J., Adel, Wenzel, MacCrate and Schmidt, JJ.


In an action for a judgment declaring the rights of the parties to certain premises, an order was made granting defendant's motion to dismiss the complaint for failure to state facts sufficient to constitute a cause of action. Another order was made denying plaintiff's motion to restrain the defendant, during the pendency of the action, from removing plaintiff or his property from the premises. Orders unanimously affirmed, with one bill of $10 costs and disbursements. No opinion.
