DECISION AND ORDER ON MOTION

Application to take judicial notice of certain documents.

Upon the papers filed in support of the application and the papers filed in response thereto, it is

ORDERED that the application is denied, without costs, and without prejudice to the issue involved being raised upon the argument of the appeal. Appellant shall file and serve a supplemental brief, on or before November 13, 2013, solely containing arguments why the Court should take judicial notice of Local Law Number 3 of 1978 of the Town of Babylon. Appellant shall attach, as an addendum to the supplemental brief, the certified copy of said document which was included with respondent's letter to this Court dated October 1, 2013. Respondent shall file and serve a supplemental brief, if any, on or before November 29, 2013, solely in response to the arguments raised by appellant in his supplemental brief.
