JAMES FRANCESCO WISE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the County Criminal Court No. 4 Dallas County, Texas Trial Court Cause No. M22-75018

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

Before this Court is Appellant's attorney's March 27, 2024 motion to withdraw as counsel on appeal and abate for appointment of substitute counsel. Appellant's attorney has discovered a potential conflict of interest in this case and has formed the opinion that Appellant would be best served by having an attorney appointed to represent him on appeal who is not a member of the Dallas County Public Defender's Office. We GRANT Appellant's attorney's motion, and we ABATE this case to the trial court for appointment of substitute appellate counsel.

We ORDER the trial court to appoint substitute appellate counsel within

TEN DAYS of the date of this order. The appeal will be reinstated after the trial court transmits to this Court an order appointing new counsel for Appellant or at such other time as the Court deems proper.

We DIRECT the Clerk of the Court to send copies of this order to the Honorable Dominique Torres Williams, County Criminal Court No. 4, John F. Warren, Dallas County Clerk, and counsel for all parties.
