MEMORANDUM OPINION


The record was due in this appeal on February 8, 2003. The record was not filed. By letter dated February 18, 2003, the Court directed the clerk and court reporter to file the record within thirty days of the date of the letter. On February 20, 2003, the Court received a notice from the trial court clerk that the appellant had not paid for preparation of the record. By letter dated March 6, 2003, the Court directed the appellant to pay for the record and warned appellant that failure to do so within ten days of the date of the letter may result in dismissal of this appeal. The record has not been filed.

On March 12, 2003, the Court referred this case to mediation. On March 27, 2003, the mediator reported the case had settled prior to a mediation session being held. Based on the foregoing, the Court concludes appellant no longer wishes to prosecute this appeal. Accordingly, the Court DISMISSES this appeal for want of prosecution. Tex.R.App.P. 42.3(b) and (c).
