The Court has considered Appellant's request to consolidate two appeals and concludes the request should be GRANTED on the following terms. The above styled and numbered cause shall be consolidated with cause number 08-14-00127-CV, styled Donald Winberg and 2 W Pecos Farms v. Daniel Esch Farms, Inc., a Colorado Corporation for purposes of submission only. The two appeals will continue to proceed separately but they will be submitted for decision on the same date.
