RAY DON WILSON, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 291st Judicial District Court Dallas County, Texas
Trial Court Cause No. F18-75289-U
ORDER
We REINSTATE this appeal.
Before the Court is appellant's July 2, 2020 motion for extension of time to file appellant's brief. We GRANT the motion. Counsel has filed a motion to withdraw and tendered a supporting Anders brief rather than a brief on the merits. We ORDER counsel's Anders brief filed on the date of this order.
We VACATE our order entered June 26, 2020 requiring the trial court to conduct a hearing to determine why appellant's brief had not been filed.
Counsel's motion to withdraw contains a defective certificate of service. In the motion, counsel certifies that she served a copy of the motion to withdraw in this case on another client in an unrelated appeal. Accordingly, we ORDER counsel to file, within FIFTEEN DAYS of the date of this order, an amended motion to withdraw that certifies she has served the motion to withdraw on appellant.
We DIRECT the Clerk to transmit a copy of this order, by electronic transmission, to the Honorable Stephanie Huff, Presiding Judge, 291st Judicial District Court; and to counsel for the parties.
We FURTHER DIRECT the Clerk to mail a copy of this order, by first class mail, to Ray Don Wilson, TDCJ No. 02287884, Eastham Unit, 2665 Prison Road #1, Lovelady, Texas 75851.
