ORDER

On December 18, 2015, this Court abated this appeal to the trial court to hold a hearing to determine whether appellant desired to prosecute his appeal, whether appellant was indigent, and whether counsel had abandoned this appeal. See TEX. R. APP. P. 38.8(b)(2). On January 14, 2016, this Court received appellant's brief.

It is therefore ORDERED that this appeal is reinstated on the docket of this court. It is further ORDERED the trial court shall not conduct a hearing pursuant to the order of December 18, 2015. The State shall file its brief on or before 30 days from the date of this Order.
